Terms of Use
1The agreement
These Terms of Use ("Terms") govern your use of Contour, an iOS cycling ride recorder developed by Evanworks ("we", "us"), downloaded from the App Store. By downloading or using Contour, you agree to these Terms and to Apple's Standard Licensed Application End User License Agreement, which is incorporated into these Terms and prevails over any conflicting provision about the licensed application itself.
You must be at least 13 years old (or the minimum age required to use the App Store in your country) to use Contour. If you use Contour under a family-sharing or parental arrangement, the adult who downloaded the app is responsible for that use.
2The app and Contour Pro
Contour records your bike rides — route, speed, elevation, and data from your heart rate, power, and cadence sensors — and stores everything locally on your device. Certain advanced features (such as iCloud sync across your devices and bulk export) require Contour Pro, available as a monthly subscription, a yearly subscription, or a one-time lifetime unlock. What is included in Pro is always shown in the app before you buy.
3Subscriptions and purchases
- Billing is handled by Apple. All purchases are made through the App Store and charged to your Apple ID payment method. We never receive your payment details.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless canceled at least 24 hours before the period ends. Your Apple ID account is charged for renewal within 24 hours before the current period ends.
- Free trial. When offered, the yearly plan includes a free trial (currently one month). If you don't cancel before the trial ends, the subscription automatically converts to a paid subscription. Any offer shown on the purchase screen at the time of purchase prevails.
- Prices. Prices shown in the App Store at the time of purchase apply. Prices may vary by region and may change; changes do not affect an active subscription period.
- Manage or cancel anytime at apps.apple.com/account/subscriptions or in iOS Settings › your name › Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period.
- Lifetime unlock is a one-time purchase and may be shared through Apple Family Sharing where Apple enables it.
- Refunds are handled by Apple: reportaproblem.apple.com.
4Acceptable use
You agree not to: reverse-engineer, decompile, or attempt to extract the source code of Contour (except as permitted by law); rent, resell, or distribute the app; circumvent or assist others in circumventing Pro feature restrictions or Apple's payment system; use the app in any way that violates applicable law; or interfere with third-party services the app relies on (such as the OpenStreetMap and Open-Meteo APIs).
5Your data
Your rides and settings belong to you. Contour stores them locally; sync (if you enable it) stays inside your own iCloud account. We do not collect, sell, or share your personal data — see the Privacy Policy for details.
6Safety and accuracy of data — please read
- Cycling on public roads has inherent risks. You are responsible for riding safely and obeying traffic laws. Do not operate your phone while riding.
- Power figures may come from your paired power meter or from estimation; the app labels the source, but neither is a certified measurement instrument.
- Route data (including OpenStreetMap-based road snapping and map tiles) is provided "as is" and may be incomplete or inaccurate. Roads and trails shown on any map in the app may be unsafe, closed, or illegal to ride.
7Third-party services and content
Contour uses Apple Maps (MapKit) for map display, the OpenStreetMap Overpass API for road-snapping (© OpenStreetMap contributors, under the Open Database License (ODbL)), and the Open-Meteo elevation API. These services belong to their respective providers, are used in accordance with their terms, and may change or become unavailable at any time. Features that depend on them (maps, road snapping, elevation correction) may degrade accordingly.
8Intellectual property
Contour — its design, code, graphics, and text — is owned by Evanworks and protected by intellectual-property law. Apple is not a party to these Terms and has no responsibility for Contour, beyond what the Standard EULA states. These Terms grant you no rights in Contour other than the personal, non-transferable right to use it as permitted by the App Store terms. Your own data remains yours.
9Disclaimers
Contour is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, or accuracy of recorded data — to the maximum extent permitted by law. We do not warrant that the app will be error-free, that features will remain available, or that data will never be lost — back up rides you care about (the app offers JSON export for exactly this).
10Limitation of liability
To the maximum extent permitted by law, Evanworks is not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or goodwill arising from your use of Contour. Our total aggregate liability for anything connected with the app is limited to the greater of the amount you paid us in the twelve months before the claim (which, given we sell only through Apple, may be zero) or the amount to which we are liable by law notwithstanding this clause. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.
11Termination and changes
You can stop using Contour at any time; deleting the app ends your use. We may update or discontinue the app or specific features at any time — features may be added, changed, or removed in future versions. If we change these Terms, we will update this page and its date; material changes will be reflected in an app update. Your continued use after publication constitutes acceptance of the updated Terms.
12Governing law
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Nothing here affects the mandatory consumer-protection rights of your jurisdiction of residence.
